A. AS A PATIENT, YOU HAVE THE RIGHT TO:

As a patient in Progressive Surgery Center, you have the right, consistent with law (NYSDOH 10 NYCRR, Section 751.9), to: 

  1. Receive services(s) without regard to age, race, color, sexual orientation, religion, marital status, sex, national origin, or sponsor;
  2. be treated with consideration, respect, and dignity, including privacy in treatment;
  3. be informed of the services available at the center;
  4. be informed of the provisions for off-hour emergency coverage;
  5. be informed of the charges for services, eligibility for third-party reimbursements, and, when applicable, the availability of free or reduced-cost care;
  6. receive an itemized copy of his/her account statement, upon request;
  7. obtain from his/her health care practitioner, or the health care practitioner’s delegate, complete and current information concerning his/her diagnosis, treatment, and prognosis in terms the patient can be reasonably expected to understand;
  8. receive from his/her physician information necessary to give informed consent prior to the start of any nonemergency procedure or treatment or both. An informed consent shall include, as a minimum, the provision of information concerning the specific procedure or treatment or both, the reasonably foreseeable risks involved, and alternatives for care or treatment, if any, as a reasonable medical practitioner under similar circumstances would disclose in a manner permitting the patient to make a knowledgeable decision;
  9. refuse treatment to the extent permitted by law and to be fully informed of the medical consequences of his/her action;
  10. refuse to participate in experimental research;
  11. voice grievances and recommend changes in policies and services to the center’s staff, the operator, and the New York State Department of Health without fear of reprisal;
  12. express complaints about the care and services provided and to have the center investigate such complaints. The center is responsible for providing the patient or his/her designee with a written response within 30 days if requested by the patient indicating the findings of the investigation. The center is also responsible for notifying the patient or his/her designee that if the patient is not satisfied by the center response, the patient may complain to the New York State Department of Health’s Office of Health Systems Management;
  13. privacy and confidentiality of all information and records pertaining to the patient’s treatment;
  14. approve or refuse the release or disclosure of the contents of his/her medical record to any health-care practitioner and/or health-care facility except as required by law or third-party payment contract;
  15. access his/her medical record pursuant to the provisions of section 18 of the Public Health Law, and Subpart 50-3 of this Title;
  16. authorize those family members and other adults who will be given priority to visit consistent with your ability to receive visitors; and
  17. when applicable, make known your wishes in regard to anatomical gifts. Persons sixteen years of age or older may document their consent to donate their organs, eyes, and/or tissues, upon their death, by enrolling in the NYS Donate Life Registry or by documenting their authorization for organ and/or tissue donation in writing in a number of ways (such as health care proxy, will, donor card, or other signed paper). The health care proxy is available from the center;
  18. view a list of the health plans and the hospitals that the center participates with; and
  19. receive an estimate of the amount that you will be billed after services are rendered.

Per CMS and/or AAAHC, the patient has the right to:

  1. Be treated with respect, consideration, and dignity.
  2. Personal privacy.
  3. Receive care in a safe setting.
  4. Be free from all forms of abuse or harassment.
  5. Be free from any act of discrimination or reprisal.
  6. Voice grievances regarding treatment or care that is (or fails to be) furnished.
  7. Be fully informed about a treatment or procedure and the expected outcome before it is performed.
  8. Be provided information concerning their diagnosis, evaluation treatment, and prognosis.  When it is medically inadvisable to give such information to a patient, the information is provided to a person designated by the patient or to a legally authorized person.
  9. Be given the opportunity to participate in decisions involving their health care, except when such participation is contraindicated for medical reasons.
  10. If a patient is adjudged incompetent under applicable state laws by a court of proper jurisdiction, the rights of the patient are exercised by the person appointed under state law to act on the patient’s behalf.
  11. If a state court has not adjudged a patient incompetent, any legal representative or surrogate designated by the patient in accordance with state law may exercise the patient’s rights to the extent allowed by state law.
  12. Be informed of their right to change providers if other qualified providers are available.

If you have a concern, problem or complaint related to any aspect of care during your stay, speak to your doctor, nurse or staff member. Many facilities have a patient representative or office to assist you in resolving concerns. If the staff can not resolve the problem, you may contact the New York State Department of Health office in your area for assistance. This local office can advise you about what to do if you have specific complaints, problems or questions. B. AS A PATIENT, YOU ARE RESPONSIBLE FOR:

Patient Responsibilities:

  1. Provide complete and accurate information to the best of his/her ability about his/her health, any medications, including over-the-counter products and dietary supplements, and any allergies or sensitivities.
  2. Follow the treatment plan prescribed by his/her provider and participate in his/her care.
  3. Inform your provider about any living will, medical power of attorney, or other directives that could affect your care.
  4. Provide a responsible adult to transport him/her home from the facility and remain with him/her for 24 hours, if required by his/her provider.
  5. Accept personal financial responsibility for any charges not covered by his/her insurance, including accepting financial responsibility for all/any charges not covered by your insurance. Example:  deductibles, coinsurances and co-payments.
  6. Be respectful of all the health care professionals and staff, as well as other patients.
  7. To observe the center’s policies and procedures.
  8. To keep appointments as scheduled or advise the center in a timely manner if an appointment cannot be kept.

If you believe that the care provided to you in a hospital (Progressive Surgery Center) by a doctor was improper, you may file a complaint with the New York State Department of Health:

If you need an interpreter, one will be provided for you.  If you have someone that can translate confidential, medical, and financial information for you, please make arrangements to have them accompany you on the day of your procedure.

All patients receiving care in a facility licensed by the New York State Department of Health, such as Progressive Surgery Center, have a right to execute an advanced directive, an example of which is a health care proxy.  The New York Health Care Proxy law allows you to appoint someone you trust, for example, a family member or close friend, to make health care decisions for you if you lose the ability to make decisions yourself.  In accordance with NYS law, Progressive Surgery Center must inform you that we are not required to honor and do no honor Do Not Resuscitate (DNR) directives.  A healthcare power of attorney will be honored.  If you already have a health care proxy, please bring it with you on your date of surgery.  If you would like a copy of the New York State Health Care Proxy, please call us at (631) 694-0000 or ask the receptionist upon your arrival.  New York State Department of Health website www.health.state.ny.us also has these forms available.
